Your usage of the website (going forward referred to as ‘the website’), owned by Michaela Bartoskova (going forward referred to as ‘MichaelaSound’):

1. Using ‘the website’ is agreement with this Disclaimer and Privacy Statement and the policies contained therein. You may signal your disagreement to these terms by failing to visit ‘the website’.

2. MichaelaSound respects your right to privacy and complies with her obligations under the European data protection acts.

3. This Privacy Statement is governed by the laws of England and Wales and is subject to the exclusive jurisdiction of the courts of England and Wales.

4. MichaelaSound does not store your credit card information, number, expiry date or CVV security code on my servers. To ensure optimal security, MichaelaSound uses a third party Stripe for all credit card billing. Stripe uses a PCI-DSS compliant SSL platform, secured by encryption and authentication. MichaelaSound takes all reasonable steps (including appropriate technical and organisational measures) to protect your personal data.

5. MichaelaSound collects GDPR compliant date for the purpose of her Mailing list. You are automatically sign-up for her newsletter and you can unsubscribe anytime.

6. MichaelaSound uses personal data to provide you with services you have signed-up for and for to update you on new services via a newsletter. No data is sold or shared with except where MichaelSound has a statutory requirement to do so. MichaelaSouns only holds personal information that you voluntarily submit it to her.

   1. Personal Data - This is data that identifies you or can be used to identify or contact you and may include your name, email address, user IP addresses in circumstances where they have not been deleted, clipped or anonymised.

   2. Non-Personal Data – MichaelaSound uses the non-personal data gathered from visitors to her website in to get a better understanding of where her visitors come from and to help her provide services best suited to the preferences of visitors.

7. The ‘website’ uses cookies to improve the quality of the service. You may decline using these, via your browser, but this may adversely affect the functions of the website.

ZOOM ONLINE WORKSHOPS

1. Payment (Non-Refundable once accepted by MichaelaSound)

2. Scheduling

All workshops are scheduled ahead and it is important to click on the zoom link (an email with essential details is sent to you within 48 hours after booking) 5 minutes before the workshop is due

3.  Absences, Cancellations, and Rollovers

a) An absence is defined as failure to join the online workshop 10 minutes or greater past the workshop start time. An absence forfeits a make-up workshop.

b) No cancellations available.

c) Any absences or cancellations verifiably beyond the client’s control may be accepted and the booking payment can be sent back.

4. Obligations

MichaelaSound promises relevant curriculum backed by peer-reviewed research and/or personally tested experience and her qualification.

5.Additional details

1. Practice in a safe space. MichaelaSound recommends refraining from eating 2 hours before the session and making sure you are hydrated 2 hours before the session commences.

2. MichaelaSound advises having internet connection, where your service provider has declared that you have sufficient data speed. MichaelaSound can make no guarantee on the quality of your streaming quality or resolution.

3. Using the ‘website’ you are participating at your own risk, with everything you do, being entirely carried out as your choice. MichaelaSound does not accept any liability whatsoever for any injury or damage arising from the use of this website and/or from participating in the workshop.

4. MichaelaSound is not medical professionals and offers no medical advice or diagnosis. This website is for your education and your enjoyment. All physical exercise can be strenuous and involve risk and so you are advised to seek the advice of your medical professional before embarking in any form of physical exercise, especially if you have limiting conditions or are pregnant, taking regular medication, recovering from injuries or have any existing medical conditions. It is your responsibility to assure that the workshops you take are appropriate for your physical and metal conditions/limitations.

5. The ‘website’s’ content is not directed for people under 18 years of age, and by going through the sign-up process, you are declaring yourself to be over 18 and legally able to make purchase agreements in the form of one-time, monthly (or yearly) plans. If MichaelaSound becomes aware that someone under the age of 18 has submitted information to her, she will remove information.

6. Each registration is for a single user and you may not provide the zoom link details to any third party. MichaelaSound will not be liable for loss occurred for failure to comply with this. There is no permission granted to download, copy, store or redistribute content.

7. MichaelaSound is not liable for any loss or damages arising out of or in connection with your use of the website and/or participating in the workshops. MichaelaSound is not liable for any damages whatsoever resulting from the statements or conduct of any third party or the interruption, suspension or termination of any services, whether such interruption, suspension or termination was justified or not, negligent, inadvertent or intentional.

8. Materials on the Service, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, artwork, software and other elements (collectively, “Material“) are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by MichaelaSound or by third parties that have licensed or otherwise provided their material to MichaelaSound. You acknowledge and agree that all materials on the service are made available to you for limited, non-commercial, personal use only. Material on the ‘website’ may not be used for any commercial person without explicit permission from MichaelaSound.

9. These Terms Of Use are governed by and construed in accordance with the laws of England and Wales and you hereby submit to the exclusive jurisdiction of the Courts of England and Wales. This will not prevent MichaelaSound from pursuing a claim for breach of contract, copyright infringement or otherwise in respect of these terms and conditions in any other jurisdiction throughout the world.
